FoliumAI, Inc., its affiliates and their successors and assigns (collectively referred to as “FoliumAI”) makes available its AI-powered platforms, hosting solutions, and related services described in FoliumAI’s published service descriptions subject to these Terms of Service (the “TOS”).
For the purposes of the TOS, the word “you” means the individual requesting one or more services provided by FoliumAI, and, if applicable, includes any other legal entity on behalf of which an individual makes such a request. Additionally, you agree not to make such a request on behalf of any other legal entity unless you have the authority to bind that legal entity to the TOS.
ACCEPTANCE OF TERMS
Capacity. You represent and warrant to FoliumAI that you have the legal capacity to enter into a binding agreement in the province, state, territory, or country in which you reside. If you do not have such capacity, do not request services from FoliumAI unless your parent or guardian enters into the TOS on your behalf.
Agreement. PLEASE READ THESE TOS CAREFULLY. BY CLICKING “I AGREE” OR CHECKING A BOX ON ANY ORDER FORM, YOU CONFIRM YOUR ACCEPTANCE AND AGREE TO BE BOUND BY THE TOS, INCLUDING ALL POLICIES AND TERMS INCORPORATED BY REFERENCE. YOUR USE OF FOLIUMAI SERVICES CONFIRMS YOUR ACCEPTANCE.
Compliance. You further represent and warrant that your use of any FoliumAI service will not violate any applicable law or regulation in your jurisdiction. If you are unable or unwilling to comply, you must not request services from FoliumAI.
YOU
Services. The services you request from FoliumAI by means of the online order form on the Site or otherwise in writing and which FoliumAI agrees to provide subject to these TOS are the “Services.”
Your Information. You represent and warrant that all information you provide about yourself is true, accurate, and complete, and you agree to promptly update such information as necessary.
Privacy. You have read FoliumAI’s Privacy Policy and consent to the collection, use, and disclosure of your personal information as described therein.
Communications. FoliumAI may contact you regarding the Services and your use of its Site. You consent to FoliumAI using any contact details you provide for this purpose.
Passwords. If you are given a username and/or password for accessing Services, you are responsible for maintaining the confidentiality of those credentials and all activity that occurs under them. You agree to notify FoliumAI immediately of any unauthorized use.
Insurance. You are responsible for maintaining, at your own cost, insurance against such risks and in such amounts as would reasonably be expected by persons engaged in similar activities as yourself.
DESCRIPTION OF SERVICES
General.
For each package of AI-driven solutions, hosting, or related services that FoliumAI provides, FoliumAI has prepared and published a service description (each a “Service Description”). The Service Descriptions are available on Folium.ai
Changes to Services. FoliumAI may modify its Services and the corresponding Service Descriptions from time to time. Please refer to the Site for the latest details.
AI & Hosting Environment. FoliumAI shall:

Maintain and operate the infrastructure required to provide its AI models, APIs, and hosting environments.

Use commercially reasonable efforts to maintain uptime, performance, and reliability of its systems, including environmental controls and safeguards where applicable.
Internet Access. FoliumAI shall provide an Internet connection linking your hosted applications or AI solutions to the web.
Backup. Unless expressly included in your Service plan, FoliumAI’s backup activities are primarily for its own disaster recovery purposes. YOU ARE RESPONSIBLE FOR BACKING UP YOUR CONTENT. FoliumAI may offer optional automated backup services for an additional fee or as part of certain service packages.
Maintenance. When possible, maintenance will be performed during scheduled low-traffic maintenance windows. Notice will be provided in advance when reasonable.
Availability. FoliumAI will use reasonable efforts to ensure Services are available at least 99.9% of the time, excluding scheduled maintenance or factors outside FoliumAI’s control.
CONTENT
Intellectual Property. No intellectual property rights are transferred to you by these TOS. FoliumAI retains all rights in its AI models, code, infrastructure, and related technology.
Your Content. “Your Content” includes all data, text, media, code, or information you upload, store, process, or transmit using the Services. You grant FoliumAI and its personnel the right to use Your Content only as required to provide the Services.
Monitoring. While FoliumAI is not obligated to monitor content, it reserves the right, subject to applicable law, to investigate Your Content and may block or remove material it deems in violation of these TOS.
ACCEPTABLE USE
You may not use FoliumAI’s Services or infrastructure for unlawful, illegal, or inappropriate activities. Prohibited uses include (but are not limited to):

Uploading, distributing, or generating harmful content such as malware, phishing tools, or scripts used to attack systems.

Using AI outputs or hosting resources to promote hate, violence, or discrimination.

Distributing copyrighted or unlicensed material without permission.

Sending spam, unsolicited emails, or other abusive communications.

Hosting or distributing sexually explicit or harmful content (including child exploitation).

Attempting to gain unauthorized access to systems or subvert security measures.

Running resource-intensive applications that disrupt FoliumAI’s services or other customers.
FoliumAI reserves the right to suspend or terminate Services in cases of unacceptable use.
IP ADDRESSES
If FoliumAI assigns you one or more IP addresses for use with Services, you acknowledge that you have no ownership rights in those IPs. FoliumAI may reassign or change such addresses at any time, with reasonable notice if practicable.
